These policies apply to applicants and approved participants in the LDS Global Adventures Affiliate Program.

Part I

Affiliate Program Terms and Conditions

These terms govern participation in the affiliate program operated by LDS Service & Transport, S.A., doing business as LDS Global Adventures (“LDS,” “we,” “us,” or “our”).

1. Acceptance and eligibility

By applying to or participating in the program, the applicant or approved affiliate (“Affiliate”) agrees to these Terms. The Affiliate must be legally capable of entering this agreement and must provide complete, accurate, and current information.

Submitting an application does not guarantee acceptance. LDS may approve or reject any application and may request additional verification. Only approved Affiliates may identify themselves as participants in the program.

2. Independent relationship

The Affiliate acts as an independent contractor and is not an employee, agent, legal representative, partner, franchisee, or joint venturer of LDS. The Affiliate cannot bind LDS or make commitments, guarantees, reservations, refunds, or representations on its behalf.

3. Referral links, coupons, and attribution

LDS may issue a unique referral link and coupon code. A referral is attributable only when the system correctly records the assigned code or link. LDS’s WooCommerce and affiliate-platform records will control if a discrepancy occurs.

LDS is not responsible for tracking lost because of an incorrect link, deleted or blocked cookies, browser restrictions, technical interruption, customer error, or failure to use the assigned coupon.

4. Commission

Unless LDS confirms a different rate in writing, the standard commission is 10% of the eligible booking value actually received and retained by LDS.

Commission is not earned on taxes, entrance or admission fees, government charges, gratuities, payment-processing fees, third-party services, complimentary services, discounts, refunds, chargebacks, or other excluded costs.

Deposit bookings: The dashboard may initially show commission calculated only on the online deposit. When applicable, LDS will manually reconcile the remaining eligible commission after the tour is completed and full payment—including any balance paid in cash—has been received.

Dashboard figures are estimates until LDS reviews and approves them.

5. When a commission becomes payable

A commission becomes eligible only when all of the following are true:

  • The customer used the Affiliate’s valid referral link or coupon code.
  • LDS received full eligible payment.
  • The customer completed the tour or service.
  • The applicable cancellation or refund period has passed.
  • The transaction is not fraudulent, disputed, refunded, cancelled, duplicated, or charged back.

Orders shown as pending, on hold, processing, or unpaid do not represent guaranteed or payable commission.

6. Payment of commission

Approved commissions will be paid according to the payment schedule and method communicated by LDS. LDS may require valid identity, payment, and tax information before issuing payment.

The Affiliate is responsible for its taxes, reporting duties, bank charges, transfer fees, and other obligations. LDS may withhold or offset amounts connected to refunds, chargebacks, duplicate payments, suspected fraud, breaches of these Terms, or money owed to LDS.

7. Customer discounts

Any customer discount associated with an Affiliate coupon is established by LDS and may be changed, restricted, suspended, or discontinued. A discount may apply only to the online amount shown at checkout and may exclude cash balances, taxes, entrance fees, sale items, and third-party charges. Coupons cannot be combined unless expressly authorized by LDS.

8. Prohibited conduct

The Affiliate must not:

  • Make false, deceptive, misleading, or unauthorized claims.
  • Represent itself as an LDS employee or authorized legal agent.
  • Change or misstate prices, availability, inclusions, policies, or tour details.
  • Promise refunds, upgrades, availability, discounts, or special treatment without written approval.
  • Use spam, unsolicited communications, fake reviews, deceptive advertising, or unlawful marketing.
  • Bid on LDS Global Adventures, LDS Service & Transport, S.A., or confusingly similar terms in paid search without written permission.
  • Create domains, profiles, pages, or advertisements that impersonate LDS.
  • Publish codes on unauthorized coupon, cashback, discount, or deal websites.
  • Create self-referrals or use its own code for personal bookings.
  • Manipulate clicks, cookies, orders, referrals, conversions, or commissions.
  • Misuse, sell, disclose, or retain customer personal information.
  • Act in a way that may harm LDS, its customers, suppliers, communities, reputation, or business relationships.

9. Brand and promotional content

LDS grants an approved Affiliate a limited, revocable, non-exclusive, and non-transferable permission to use authorized LDS materials solely to promote eligible services while the account remains active. All trademarks, logos, photographs, videos, website content, and other materials remain the property of LDS or their respective owners.

10. Reservations and customer relationship

All reservations remain subject to LDS’s current booking, payment, safety, cancellation, and refund policies. LDS retains sole control over prices, availability, operations, customer service, acceptance of reservations, modifications, cancellations, and refunds. Program participation does not guarantee bookings, income, commission, availability, or continued acceptance.

11. Fraud, cancellations, and refunds

No commission is payable on a cancelled, refunded, fraudulent, duplicate, test, self-referred, disputed, unpaid, or charged-back transaction. If LDS already paid an ineligible commission, it may deduct that amount from a future payment or request reimbursement.

12. Confidentiality and data protection

The Affiliate must protect confidential business and customer information and comply with applicable privacy, advertising, electronic-communication, and data-protection requirements. Customer data may be used only for the authorized referral activity and may not be sold or disclosed.

13. Suspension and termination

Either party may end participation at any time. LDS may immediately suspend or terminate an account because of suspected fraud, misleading advertising, brand misuse, customer complaints, inactivity, violation of these Terms, or conduct harmful to LDS.

After termination, the Affiliate must stop using LDS links, codes, branding, and materials. Legitimate commissions earned before termination may be paid after review; fraudulent or noncompliant commissions are forfeited.

14. Program and policy changes

LDS may modify commission rates, discounts, eligibility rules, payment procedures, program features, or these Terms. Material updates may be communicated through the website, Affiliate Portal, or email. Continued participation after an update constitutes acceptance of the revised Terms.

15. Limitation of liability

To the fullest extent allowed by law, LDS is not liable for indirect, incidental, special, punitive, or consequential damages; expected profits or commissions; data loss; technical interruption; or tracking failure related to the program. Nothing in these Terms excludes liability that cannot legally be excluded.

16. Indemnification

The Affiliate agrees to defend, indemnify, and hold harmless LDS Service & Transport, S.A., LDS Global Adventures, and their owners, employees, contractors, and representatives from claims, losses, penalties, damages, costs, and reasonable legal expenses resulting from the Affiliate’s advertising, representations, misconduct, legal violations, breach of these Terms, or misuse of intellectual property or personal information.

17. Governing law

These Terms are governed by the laws of the Republic of Panama. The parties will first attempt to resolve a dispute in good faith. Any unresolved dispute will be submitted to the competent courts of the Republic of Panama, subject to applicable mandatory law.

18. Severability and entire agreement

If any provision is unenforceable, the remaining provisions continue in effect. These Terms, applicable LDS policies, and written program communications constitute the agreement governing program participation.

Part II

Affiliate Privacy Policy

This policy explains how LDS collects, uses, stores, and protects personal information associated with the Affiliate Program.

1. Data controller

LDS Service & Transport, S.A., doing business as LDS Global Adventures, is responsible for personal information processed through the Affiliate Program. Questions or privacy requests may be sent to info@ldsglobaladventures.com.

2. Information we may collect

  • Name, email address, username, password credentials in protected form, telephone number, country, and business information.
  • Website, social-media profile, promotional channel, preferred coupon code, and application responses.
  • Referral-link clicks, coupon use, conversions, order identifiers, eligible sales, commission, and payout history.
  • Payment, identity, and tax information when required to issue or verify payments.
  • IP address, device, browser, login, cookie, security, and technical information.
  • Messages, support requests, compliance reviews, and records of consent.

3. Why we use information

We may process information to:

  • Evaluate applications and create or administer Affiliate accounts.
  • Generate referral links and coupons and track clicks, orders, and commissions.
  • Review, reconcile, approve, and pay eligible commission.
  • Communicate program updates, account notices, support responses, and required policy changes.
  • Prevent fraud, self-referrals, manipulation, abuse, security incidents, and policy violations.
  • Maintain records, fulfill legal and tax obligations, resolve disputes, and enforce agreements.
  • Improve program operation, security, usability, and performance.

4. Legal grounds and consent

Information is processed as necessary to review an application, establish and perform the Affiliate relationship, comply with legal obligations, protect legitimate business and security interests, resolve claims, and when applicable, based on the Affiliate’s consent.

By submitting the registration form, the applicant acknowledges the purposes described in this policy and consents where consent is required. Consent may be withdrawn for future processing, but doing so may prevent continued program participation when the information is necessary to administer the account.

5. Cookies and referral tracking

The Affiliate Portal and referral system may use cookies or similar technology to keep users signed in, maintain security, record referral visits, associate a customer’s booking with an Affiliate, and measure program performance. Blocking or deleting cookies may prevent accurate attribution.

6. When information may be shared

We may share only the information reasonably necessary with service providers that support website hosting, WooCommerce, affiliate tracking, email delivery, security, analytics, payment processing, accounting, legal compliance, and technical support.

Information may also be disclosed when legally required, to protect rights or safety, investigate fraud, enforce these Terms, complete a corporate transaction, or with the individual’s authorization. LDS does not sell Affiliate personal information.

7. International processing

Some technology or payment providers may process information outside Panama. When cross-border processing occurs, LDS will use reasonable contractual, organizational, and security measures appropriate to the information and applicable requirements.

8. Retention

Information is retained only for as long as reasonably necessary to administer the program, maintain financial and transaction records, meet tax or legal obligations, prevent fraud, resolve disputes, and enforce agreements. Retention periods may vary according to the type of record and applicable requirements.

9. Security

LDS uses reasonable administrative, technical, and organizational measures designed to protect information from unauthorized access, alteration, disclosure, loss, or misuse. No internet transmission or storage system can be guaranteed completely secure.

10. Privacy rights

Subject to applicable law, individuals may request access to their personal information, correction of inaccurate or incomplete information, deletion or cancellation when appropriate, opposition to certain processing, withdrawal of consent, or portability of eligible data.

To submit a request, email info@ldsglobaladventures.com with the subject “Affiliate Privacy Request.” LDS may take reasonable steps to verify identity before responding.

11. Automated decisions

Tracking tools may automatically calculate statistics or flag activity for review. LDS does not rely solely on an automated process to make a decision that produces a significant adverse legal effect without appropriate review where required by law.

12. Third-party websites

The Affiliate Portal or website may link to third-party services. Their privacy and security practices are governed by their own policies, and LDS is not responsible for those practices.

13. Children

The Affiliate Program is intended for adults legally capable of entering a binding agreement. LDS does not knowingly accept applications from children.

14. Policy changes

LDS may update this policy to reflect program, technology, operational, or legal changes. The revised date will appear at the top of this page, and material updates may also be communicated through the Affiliate Portal or email.
