TERMS AND CONDITIONS OF LDS GLOBAL ADVENTURES

Please read these Terms and Conditions carefully. By booking or using any service provided by LDS GLOBAL ADVENTURES, you agree to be legally bound by these terms.


1. Company Scope

LDS GLOBAL ADVENTURES operates as a Type A and Type B Tour Operator in Panama, providing services including but not limited to:

  • Transportation (private and shared)

  • Tours and excursions

  • Travel coordination

  • Booking management for third-party services

We act as an intermediary and service coordinator, not as the direct provider of all services.


2. Assumption of Risk (MANDATORY ACCEPTANCE)

By using our services, you voluntarily assume all risks, known or unknown, including but not limited to:

  • Personal injury or death

  • Property damage or loss

  • Delays, cancellations, or interruptions

  • Natural disasters, weather, or road conditions

  • Acts of third parties

You agree that participation in tours, transportation, and activities is entirely at your own risk.


3. Waiver of Liability (STRONG CLAUSE)

To the fullest extent permitted by law, you release, waive, discharge, and hold harmless LDS GLOBAL ADVENTURES, its owners, employees, affiliates, and partners from any and all claims, including:

  • Negligence (including alleged negligence)

  • Personal injury, disability, or death

  • Loss or damage of personal property

  • Emotional distress

  • Financial losses

This applies whether the incident occurs before, during, or after the service.


4. Third-Party Services (CRITICAL PROTECTION)

LDS GLOBAL ADVENTURES does not own or control all service providers (including transportation, boats, accommodations, guides, or activities).

  • All third-party providers operate independently.

  • We do not guarantee their performance, safety, or compliance.

  • We are not liable for any act, omission, delay, negligence, or failure of any third-party provider.

By booking with us, you agree that any claim must be directed to the third-party provider, not LDS GLOBAL ADVENTURES.


5. Payment Terms (NON-REFUNDABLE PROTECTION)

  • A non-refundable deposit is required to confirm any reservation.

  • The remaining balance must be paid as instructed (cash or agreed method).

  • Prices may change without notice until booking is confirmed.

All payments are considered acceptance of these Terms.


6. Cancellation & Refund Policy (STRICT VERSION)

  • Cancellations 48+ hours before service: refund may be issued at our sole discretion.

  • Cancellations within 48 hours: no refund guaranteed.

  • No-shows: 100% charge, no refund.

Refunds are subject to:

  • Third-party policies

  • Operational costs already incurred

LDS GLOBAL ADVENTURES reserves the absolute right to deny refunds.


7. Force Majeure (VERY IMPORTANT)

We are not responsible for failure or delay caused by events beyond our control, including but not limited to:

  • Weather conditions

  • Government actions

  • Road closures

  • Strikes

  • Natural disasters

  • Pandemics

No refunds or compensation will be issued under these circumstances.


8. Passenger Responsibility

Passengers must:

  • Follow all instructions from staff and partners

  • Comply with local laws and regulations

  • Act respectfully at all times

We reserve the right to refuse or terminate service without refund if a passenger:

  • Is disruptive

  • Violates laws

  • Poses a risk to others


9. Personal Property Disclaimer

LDS GLOBAL ADVENTURES is not responsible for lost, stolen, or damaged belongings, including luggage, electronics, or valuables at any time.


10. Guna Yala Territory – Legal Disclaimer

Guna Yala is a semi-autonomous indigenous territory, governed by the Guna Congreso.

  • All services in the region are provided exclusively by authorized Guna operators

  • We are legally required to work with these providers

  • We must prepay services, making refunds highly limited

IMPORTANT:

  • We do not control service quality within Guna Yala

  • We are not responsible for service failures, delays, or conditions

  • The Guna authorities do not provide enforcement or compensation mechanisms

By booking, you fully accept these limitations.


11. Limitation of Liability (MAXIMUM PROTECTION)

In any case, the total liability of LDS GLOBAL ADVENTURES shall never exceed the amount paid by the customer.

Under no circumstances shall we be liable for:

  • Indirect damages

  • Consequential damages

  • Loss of enjoyment

  • Lost profits or opportunities


12. Indemnification Clause

You agree to indemnify and hold harmless LDS GLOBAL ADVENTURES from any claims, damages, or legal costs arising from:

  • Your actions

  • Your negligence

  • Your violation of these terms


13. Modification of Terms

We reserve the right to modify these Terms at any time without prior notice. Continued use of our services constitutes acceptance of updated terms.


14. Governing Law

These Terms shall be governed by the laws of the Republic of Panama. Any disputes must be resolved exclusively in Panama.


15. Full Agreement

By booking or using our services, you confirm that you:

  • Have read these Terms

  • Fully understand them

  • Voluntarily agree to them
